In Canada defrauding “the public, or any person, of property, money, valuable security or any services, and for affecting the public market price of stocks, shares, merchandise or anything offered for sale to the public” constitutes the offence of Fraud.Section 380 of the Criminal Code sets out the legal definition of Fraud as; - [Domestic Assault](https://passipatel.com/milton/domestic-assault/): Domestic Assault charges are one of the most common matters that come before the Ontario Court of Justice. We, at Passi & Patel, understand that being charged with Domestic Assault is a traumatic and painful experience for both the individual and the family. Hiring a skilled Domestic Assault lawyer is crucial to ensure the best possible result. - [Aggravated Assault](https://passipatel.com/milton/aggravated-assault/): Causing actual bodily harm to a complainant during the course of an assault aggravates a ‘simple’ Assault charge to that of ‘Assault Cause Bodily Harm’. This charge is more serious than simple Assault and the sentences are greater due to the degree of harm suffered by the complainant.Section 267(b) Criminal Code of Canada defines Assault Cause Bodily Harm as: - [Assault with a Weapon](https://passipatel.com/milton/assault-with-a-weapon/): Using a weapon or an imitation weapon, or threatening to use one, during the course of an assault elevates a simple Assault charge to that of Assault with a Weapon. This charge is more serious than Assault. A weapon can be any object intended to be used to cause death or harm. - [Contact a Milton Criminal Lawyer](https://passipatel.com/milton/contact-us/): If you or someone you know has been charged with a criminal offence, the lawyers of Passi & Patel are here to help. Deprivation can be temporary or permanent. ‘Anything’ can include tangible or intangible property, inanimate or animate property. The ‘colour of right’ is defined as, good faith/honest belief in a possessory right to a thing. The offence is split in two: (1) Theft over $,5000; and, (2) Theft Under $5,000. - [Assault](https://passipatel.com/milton/assault/): Assault constitutes the non-consensual and intentional application of direct or indirect force on another person. Assault can also include an attempt, or threat, to intentionally apply direct or indirect force to another person. Assault can be referred to as ‘simple assault’ or ‘common assault’.There are various types of Assault charges defined in the Criminal Code of Canada. There are two different variations of fraud based upon the value of the property. When the value of the amount the victim alleges to have been defrauded of is under $5,000, then accused is charged with “Fraud under $5,000.” The second fraud offence one can be charged with is “Fraud over $5,000” when the value of the property, alleged to have been defrauded is at least $5,000 or more. In addition, it is common for the Crown to file multiple fraud counts against the accused in cases where the fraud occurred over an extended period of time.Section 380 with the Criminal Code of Canada defines the criminal offence of fraud, as follows:(1) Any person, who by falsehood, deceit, or other fraudulent means, regardless of whether or not it is a false pretence within the meaning of this Act, defrauds any person or the public, whether ascertained or not, of any valuable security, any property, money, or any service - [Firearm & Weapons Offences](https://passipatel.com/mississauga/firearm-weapons-offences/): Canada has very strict laws in regards to governing the purchase, registration, possession, use and sale of firearms and weapons. The Criminal Code of Canada treats the unregistered possession, use, and trafficking of firearms and weapons as some of the most serious of offences, with some of the most severe penalties and sentences under the law. Many firearms and weapons offences have significant, mandatory imprisonment sentences, while just about all have required jail sentences. There are specific Sections of the Criminal Code of Canada that deal with firearms and weapons offences. Some of the more common firearms and weapons offences a person could be charged with include: - [Drug Offences](https://passipatel.com/mississauga/drug-offences/): In Canada, the Controlled Drugs and Substances Act and the Criminal Code of Canada determine how drug offences are prosecuted. There is a very broad range of criminal drug offences and sentences, if a person is found guilty. Retaining the services of a Mississauga criminal defence lawyer, with experience defending drug offences is crucial to your case.Being charged with “possession with the purpose of trafficking,” or the similar drug offence, “trafficking a controlled substance” are considered very serious drug trafficking offences by the Canadian Justice System. It is important to note the Crown must prove whether the accused was merely in possession or had intent to traffic the drugs. The Crown typically establishes reasonable grounds for trafficking offences based upon the quantity and volume of the drugs found in possession of the accused, as well as using the factors the police use to determine whether to charge someone with drug possession or possession with the intent of trafficking. On the other hand, if a person is charged with drug possession, the Crown only has to prove the item found in possession of the person is an illegal drug and the person was in possession of it. Having the expertise and knowledge of an experienced Mississauga drug trafficking lawyer on your side will help you avoid the very serious penalties and consequences of a possession with the intent to traffic or a drug trafficking conviction. - [Domestic Assault](https://passipatel.com/mississauga/domestic-assault/): If you, a friend, or relative have been charged with a domestic assault offence, contact Passi & Patel at (416) 417-4174 now. Unlike Careless Driving, which is a provincial offence under the Highway Traffic Act, a conviction of Dangerous Driving can result in a real criminal record. Dangerous Operation is now governed by section 320.13 of the Criminal Code of Canada, and is often laid in cases involving Impaired Operation.Section 320.13(1) of the Criminal Code of Canada sets out the offence of Dangerous Operation: - [Careless Driving & Stunt Driving](https://passipatel.com/mississauga/careless-driving-stunt-driving/): Careless Driving and Stunt Driving are not criminal charges, and are prosecuted pursuant to the Highway Traffic Act (HTA). Careless Driving and Stunt Driving are considered the most serious offences under the Highway Traffic Act. Though they are not criminal in nature, being found guilty of these offences can have a number of detrimental impacts, including jail terms, increased insurance premiums, vehicle impoundment and significant fines.Section 130 of the Highway Traffic Act outlines the offence of Careless Driving. The section states: Every person is guilty of the offence of driving carelessly who drives a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway and on conviction is liable to a fine of not less than $400 and not more than $2,000 or to imprisonment for a term of not more than six months, or to both, and in addition his or her licence or permit may be suspended for a period of not more than two years.Furthermore, where the Careless Driving results in Bodily Harm or Death, the penalty range is increased: a fine between $2,000 and $5,000 and/or a jail term not more than 2 years can be imposed, and one’s driving licence or permit may be suspended for a period of not more than 5 years. Bodily Harm is defined as any injury that interferes with the health or comfort of a person and is more than transient or trifling in nature. ‘Transient or trifling in nature’ is taken to be a short amount of time and very minimal injury. - [Successes](https://passipatel.com/mississauga/successes/): Client charged with s. 320.14(1)(a) CC Impaired Operation of a Conveyance and s. 320.14(1)(b) CC Operation While Impaired – BAC Exceeding 80 mg. At trial, counsel demonstrated that contrary to the investigating officers’ testimonies, the police had entered the client’s home without there being a medical emergency, and that there was no other basis for their entry. Counsel also established that the client was funneled towards duty counsel, as the police were not reasonably diligent in facilitating a call to the client’s counsel of choice.
